BODY HOT PILATES GIVEAWAY TERMS & CONDITIONS
These Giveaway Terms & Conditions (“Giveaway Terms”) apply to all giveaways (“Giveaways”) hosted by Body Hot Pilates Corporate LLC (“Body,” “we,” “us,” or “our”). By participating, you agree to be bound by these Giveaway Terms. Each Giveaway may have additional terms that govern that specific Giveaway (“Additional Rules”). The Additional Rules will be contained in or linked to the marketing associated with that Giveaway.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN ANY GIVEAWAY HOSTED BY BODY. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED DURING THE APPLICABLE ENTRY PERIOD. VOID WHERE PROHIBITED BY LAW. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT. TRAVEL NOT INCLUDED.
1. Eligibility
Open to legal residents of the United States who are 18 years or older at the time of entry. Employees of Body and their immediate family members are not eligible. Void where prohibited.
2. Entry Period
Each Giveaway will have a specific start and end date and time (“Giveaway Period”) as indicated in the Giveaway announcement/Additional Rules. All times are Eastern Times (EST) unless otherwise stated. Entries submitted before or after the specified period will not be eligible, unless explicitly stated in the Additional Rules. Entries must be received by 11:59 PM EST on the listed end date to be eligible.
3. How to Enter
Participants must follow the instructions provided in the Giveaway announcement and/or Additional Rules, which may include submitting an entry form, subscribing to a newsletter, following a social media account, or other similar actions.
Entries generated by script, macro, or other automated means are void. Limit one (1) entry per person/email address per Giveaway unless otherwise stated. The use of multiple email addresses, social media profiles, website accounts, or other methods to create additional registrations/entries for a single individual is strictly prohibited and will result in disqualification from the Giveaway in the sole discretion of Body.
4. Prizes
The number, nature, and value of the prizes for each Giveaway may be detailed in the announcement or Additional Rules. Winners will be selected at random from all eligible entries received during the Giveaway Period. Prizes are non-transferable and may not be exchanged for cash. Body reserves the right to substitute a prize of equal or greater value at its sole discretion.
5. Prize Restrictions and Limitations
For winners of a class package membership, any cancellation within twelve (12) hours of a scheduled class, or failure to attend a class, will result in a fee being automatically charged to the credit card on file. Instructors and classes are subject to change, and classes may be cancelled without notice. When possible, the winner will be notified of any cancellation or change via email or text. If a class is full, the winner must join the waitlist. If a spot becomes available before the twelve (12) hour window, the winner will be automatically added and notified. It’s winner’s responsibility to remove himself or herself if winner can no longer attend, in order to avoid penalties.
Winners are solely responsible for any costs associated with using a prize that are not expressly listed in these Giveaway Terms or Additional Rules (including but not limited to travel expenses, parking, ground transportation, and any other costs). The winner agrees to maintain behavior in accordance with all applicable laws, studio policies, and generally accepted social practices while participating in any class.
6. Winner Selection & Notification
Winners will be selected at random from eligible entries and announced either on social media, via email, via social media handle, or in any manner indicated in the Giveaway announcement/Additional Rules.
Winners will be notified via the email address provided at entry or via their social media handle. Potential winner must respond and accept within fourteen (14) days from the notification date to formally claim the prize.
If a prize notice is returned as undeliverable, or if a potential winner fails to properly claim the prize in the manner stated in the prize notification, or if a potential winner is determined to be ineligible or otherwise out if compliance with these Giveaway Terms or the Additional Rules, or if a potential winner declines the prize, then the prize will be forfeited in its entirety and another potential winner will be selected at random from among remaining eligible entries and notified in accordance with these Terms.
If Body is unable to confirm a winner after five (5) attempts, the prize may remain unawarded at Body’s sole discretion. Body may choose not to award a prize to an alternate winner if a prize is forfeited after confirmation of a winner for any reason.
7. Publicity
By entering a Giveaway, you grant Body the right to use your name, social media handle, and/or likeness for promotional purposes without further compensation or notice, except where prohibited by law.
8. Limitations of Liability & Releases
BY ENTERING IN THIS GIVEAWAY, PARTICIPANT AGREES THAT GIVEAWAY, SPONSORS, GIVEAWAY ENTITIES AND THEIR PARENT COMPANY, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEBSITE PROVIDERS, WEB MASTERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY PARTICIPANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM OR PARTICIPATION IN THIS GIVEAWAY OR ANY GIVEAWAY RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY.
THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO CLOSURE OF A STUDIO, ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, PANDEMIC, ILLNESS, OR TERRORISM. BY PARTICIPATING IN THIS GIVEAWAY, PARTICIPANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS GIVEAWAY OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE.
9. General Conditions
Body reserves the right, at its sole discretion, to cancel, modify, or suspend any Giveaway (or any portion thereof) for any reason. Body also reserves the right, at its sole discretion, to modify these Giveaway Terms for clarification purposes without materially affecting the terms and conditions of the Giveaway.
Body reserves the right, at its sole discretion, to disqualify any individual it finds to be attempting to tamper with or undermine the entry process and/or the legitimate operation of the Giveaway; to violate these Giveaway Terms; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.
Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the responsibility solely of winner.
Participation constitutes entrant’s full and unconditional agreement to these Giveaway Terms and to Body’s decisions, which are final and binding in all matters related to the Giveaway. Body and its agencies are not responsible for lost, late, or incomplete entries; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of entry will not be deemed proof of receipt by Body. Body’s failure to enforce any term of these Giveaway Terms shall not constitute a waiver of that provision.
10. Privacy
Personal information collected during the Giveaway will be used in accordance with the Body’s standard privacy policy (at https://www.bodyhotpilates.com/privacy-policy). By entering, participants agree to receive communications from Body, including promotional materials, unless they opt out.
11. Arbitration & Class Action Waiver
As a condition of entering the Giveaway, each entrant agrees that (a) any and all disputes, claims, controversies, or causes of action arising out of or relating to the Giveaway or any prizes awarded (each, a “Claim”) shall be (i) arbitrated on an individual basis only and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party and (ii) settled by binding arbitration in Miami, Florida before a single arbitrator appointed by JAMS in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (b) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential, attorneys’ fees or any other damages, other than for actual out-of-pocket expenses. These Giveaway Terms shall be governed by and construed and interpreted in accordance with the laws of the State of Florida, U.S.A, applicable to contracts entered into and performed exclusively in that State.
12. Disclaimer
Giveaways are in no way sponsored, endorsed, or administered by any social media platform. Unless otherwise stated, Giveaway prizes are not affiliated with or provided by the brands featured. For all questions, please contact Body Hot Pilates directly.
13. Acceptance of Terms
You acknowledge and agree that Giveaways and any Body Hot Pilates class or membership will be subject to these Terms and additional terms and conditions including, without limitation, (i) Body’s standard membership policies, (ii) any applicable membership agreement(s) and/or waiver(s) for your applicable Body studio(s), and (iii) Body’s standard Terms of Service (at https://www.bodyhotpilates.com/terms-of-service).
By participating in the Giveaway, you acknowledge and agree to all of Body’s terms and conditions. Terms may be revised at any time, in our sole discretion, by updating this posting, and you agree to be bound by any such revisions.
